Tingimused - Terms
Üldtingimused
1. Ulatus ja kohaldatavus
1.1. Käesolevad Üldtingimused on telcotrade.eu veebilehe vahendusel Telcotrade OÜ ja ostjate vahel sõlmitud lepingute lahutamatuks osaks.
1.2. Kui Telcotrade OÜ ja ostja on kokku leppinud eritingimuse, mis on erinev Üldtingimustest, sätestatakse lepingule eritingimust.
1.3. Telcotrade.eu kodulehe külastamise või kasutamisega nõustub ostja käesolevate Üldtingimustega.
1.4. Kõikidele lepingutele, mis on sõlmitud Telcotrade OÜ ja ostja vahel, kohaldatakse Eesti Vabariigi seadusi.
2. Lepingu sõlmimine
2.1. Informatsioon telcotrade.eu veebilehel ei ole Telcotrade OÜ poolt siduv pakkumine kauba müügiks ostjale.
2.2. Ostja poolt tehtud hinnapäring ning Telcotrade OÜ automaatne kinnitus selle kättesaamise kohta ei too endaga kaasa mingisuguseid õiguslikke tagajärgi ega vii poolte vahel lepingu sõlmimiseni.
2.3. Kui Telcotrade OÜ on üle kontrollinud hinnapäringus soovitud kauba kättesaadavuse ja hinna, teeb ta ostjale e-maili teel kauba müügiks siduva hinnapakkumise. Telcotrade OÜ poolt tehtava siduva hinnapakkumise tegemiseni käsitatakse poolte vahelist suhtlemist kui lepingule eelnevaid läbirääkimisi.
3. Hind ja maksmine
3.1. Hinnad telcotrade.eu veebilehel on informatiivsed. Tuginedes ostja hinnapäringule, sätestatakse kauba täpne müügihind Telcotrade OÜ poolt tehtavas siduvas hinnapakkumises.
3.2. Telcotrade.eu veebilehel loetletud hinnad on FOB Tallinn, Eesti, hinna järel väljendatud valuutas ning ei sisalda käibemaksu (kauba müügil Euroopa Liidu juriidilistele isikutele, kes ei ole käibemaksukohustuslased, ning füüsilistele isikutele, lisatakse kauba hinnale Eesti käibemaks 18%).
3.3. Ostja kohustub tasuma hinnapakkumises märgitud kauba täishinna Telcotrade OÜ-le 10 tööpäeva jooksul alates hinnapakkumise kättesaamisest.
3.4. Kui raha pole laekunud Telcotrade OÜ arvele 10 tööpäeva jooksul peale hinnapakkumise tegemist, loetakse hinnapakkumine tagasi võetuks ning tellimus tühistatuks.
3.5. Originaalarve saadetakse ostjale koos kaubaga.
4. Tarneaeg ja transpordikulud
4.1. Kõik tarne-, tolli- ning muud transpordikulud tasub ostja ning need lisatakse telcotrade.eu veebilehel märgitud toote hinnale.
4.2. Kaup saadetakse ostjale 7 tööpäeva jooksul pärast raha laekumist Telcotrade OÜ arvele.
4.3. Kauba tarnimiseks kasutatakse erinevaid variante mis kooskõlastatakse ostjaga.
5. Garantii
5.1. Originaalarve, mis on ka garantiikirjaks, saadetakse ostjale koos kaubaga ning see hakkab kehtima hetkest, mil ostja saab kauba kätte. Garantiiperiood sõltub tootest ning varieerub ühest aastast uutele toodetele kuni ühe kuuni kasutatud varustusele.
5.2. Kui ostja tagastab kauba garantiiperioodi jooksul ning ekspertiis Telcotrade OÜ laboris tõestab, et tootel on puudus, tagastab Telcotrade OÜ toote täishinna ostjale (sealhulgas ka kauba tagastamisega seotud transpordikulud). Võimaluse korral ning ostjaga eelneval kokkuleppe olemasolul võib Telcotrade OÜ nõustuda puudusega kauba ümbervahetamisega.
5.3. Garantii ei kehti juhul kui kauba puudus on tingitud ostja poolt kauba valest kasutamisest või toote tavapärasest kulumisest.
5.4. Telcotrade OÜ garantiitingimused ei välista teisi seadusest tulenevaid ostja õigusi puudusega toodete ostmise osas.
6. Tarbijalepingutele kehtivad sätted
6.1. Lisaks artiklis 5 sätestatud garantiist tulenevatele üldistele õigustele on tarbijatel (füüsilised isikud) lisaõigus tagastada kaup 14 tööpäeva jooksul ilma igasuguse põhjenduseta alates toote kätte saamisest. Tagastatav kaup peab olema kasutamata ja originaalpakendis. Raha tagastatud kauba eest (sealhulgas transpordikulud) kantakse tagasi ostja arvele 30 tööpäeva jooksul alates müüja poolt kauba kätte saamisest.
6.2. Lisaks sätestatud 14 - tööpäevasele tagastamisõigusele ning garantiile (artikkel 5), kehtivad tarbijatele ka kõik teised neile seadusega sätestatud õigused kauba tellimisel telcotrade.eu e-poest (nagu näiteks kaheaastane pretensioonide esitamise aeg kõikidele toodetele).
7. Privaatsus
7.1. Igasugust ostjat puudutavat informatsiooni (näiteks kontaktandmed), mille ostja on avaldanud Telcotrade OÜ-le, kasutatakse ainult ostja poolt tehtud hinnapäringule vastamiseks ning siduva hinnapakkumise tegemiseks.
7.2. Igasugune kirjavahetuse sisu Telcotrade OÜ ja ostja vahel on konfidentsiaalne ning seda ei avalikustata ühelegi kolmandale osapoolele peale varustaja.
8. Vastutus ja vaidluste lahendamine
8.1. Kuigi Telcotrade OÜ teeb kõik endast oleneva välistamaks telcotrade.eu veebilehega seonduvaid viiruseid, ei võta ta endale vastutust viiruste eest, mis on saadud materjali allalaadimisega telcotrade.eu veebilehelt ning ostja peab selles osas ise kasutusele võtma kõik vajalikud turvameetmed.
8.2. Telcotrade OÜ ei ole informatsiooni eest, mida võib leida telcotrade.eu kodulehel viidatud teistelt veebilehtedelt. Kuna telcotrade.eu kodulehel viidatud veebilehed on hallatavad kolmandate isikute poolt, peab ostja eraldi tutvuma viidatud veebilehe kasutamisetingimustega.
8.3. Telcotrade OÜ ja ostja vahelistele vaidlustele, mis tulenevad kauba müügist telcotrade.eu e-poest, kohaldatakse Eesti Vabariigi seadusandlust.
9. Üldtingimuste muutmine
9.1. Käesolevaid Üldtingimusi muudeti viimati 15.05.2008.
9.2. Telcotrade OÜ jätab endale õiguse oma äranägemise järgi käesolevaid Üldtingimusi vajadusel muuta.

Standard Terms of Purchasing
1. Scope and Applicability
1.1. These Standard Terms of Purchasing (hereinafter the Terms) are an inseparable part of all the contracts made between Telcotrade OÜ and the purchaser for the sale of goods from telcotrade.eu online catalogue.
1.2. If a specific rule is agreed upon between Telcotrade OÜ and the purchaser, which is different from the Terms, the more specific rule prevails over these Terms.
1.3. By accessing or using telcotrade.eu website, the purchaser agrees to the conditions set for in these Terms.
1.4. The laws of the Republic of Estonia apply to all the contracts between Telcotrade OÜ and the purchaser.
2. Making a Contract
2.1. The information on telcotrade.eu website does not constitute a binding offer to sell goods to the purchaser.
2.2. Purchasers request for quotation and Telcotrade OÜs automatic confirmation of receipt of such request has no legal implications and does not lead to the making of a contract.
2.3. After Telcotrade OÜ has checked the availability and price of the product requested in the quotation, it will send the purchaser e-mail with an offer to sell. All other correspondence between Telcotrade OÜ and purchaser until such an offer is considered negotiation.
3. Price and Payment
3.1. The prices on telcotrade.eu website are informative. The exact price will be stated in the offer to the purchaser based on the latters request for quotation.
3.2. The prices listed on telcotrade.eu website are FOB Tallinn, Estonia, in a currency marked next to the price and are exclusive of VAT (On the sale of goods to EU companies without a VAT number and to EU citizens, Estonian VAT of 18 % will be added to the price of the product).
3.3. Full amount of the price of the product indicated on the offer must be transferred to Telcotrade OÜs account within 10 working days after the purchaser has received the offer from Telcotrade.
3.4. If Telcotrade OÜ has not received the payment within 10 working days after making the offer to the purchaser, the offer is withdrawn and order is cancelled.
3.5. The original bill of the payment will be sent to the purchaser with the good(s).
4. Delivery and Transportation
4.1. All delivery, customs and other transportation costs are payable by the purchaser and will be added to the product price indicated on telcotrade.eu website.
4.2. The good(s) will be sent out to the purchaser within 7 working days after the payment has been arrived on Telcotrade OÜ account.
4.3. Different courier and postservices may used for the delivery of products. Will be clarified with purchaser.
5. Warranty
5.1. Original bill sent to the purchaser with the product serves also as a warranty and the time for the warranty starts running from the moment the purchaser receives the goods. The length of the warranty depends on the product and varies from 1 year for new equipment to one month for used equipment.
5.2. If the purchaser sends back the good(s) during the warranty and the inspection in Telcotrade laboratory proves that the product is faulty, Telcotrade OÜ will pay back the full product price to the purchaser, including the costs for returning the goods. In some cases, when possible and when previously agreed upon with the purchaser, Telcotrade OÜ can accept to replace the faulty unit.
5.3. Warranty is not valid in the case where the fault of the product is attributed to non-proper usage by the purchaser or to the reasonable wastage of the product.
5.4. Telcotrade OÜ warranty rules do not exclude any other legal rights that the purchasers might have according to law in case of buying faulty products.
6. Provisions specific to consumer contracts
6.1. Without prejudice to the rights applicable to all the purchasers during the warranty period (Article 5), the purchasers, who are consumers (natural persons), have an additional right to return the goods without any explanation within 14 working days after receiving the product. The returned product must be unused and in an original package. The money (including transportation costs) for the returned good(s) will be put back on the purchasers bank account within 30 working days on receipt of the product(s) by Telcotrade OÜ.
6.2. In addition to the explicit rights of withdrawal within 14 working days and the provided warranty (Article 5), the consumers also have all other rights attributed to them by law (such as the right to make complaints about the product for the period of two years after buying it).
7. Privacy
7.1. Any kind of information concerning the purchaser (e.g. contact information), that is made available to Telcotrade OÜ, will only be used for the purposes of answering the purchasers request for quotation and making an offer for the sale of goods.
7.2. Any kind of communication between Telcotrade OÜ and the purchaser is confidential and is not made available to any third party other than the supplier.
8. Liability and Dispute Settlement
8.1. Telcotrade OÜ makes all reasonable attempts to exclude viruses from telcotrade.eu website but it accepts no liability for viruses caught by downloading information from telcotrade.eu website and therefore, purchaser(s) should take all appropriate safeguards in that regard.
8.2. The links to other websites on telcotrade.eu web page are maintained by other parties and Telcotrade OÜ is not responsible for any information available on these websites. The purchasers should always separately review the terms of any other site that they access through a link from telcotrade.eu.
8.3. The laws of the Republic of Estonia are applicable to the disputes between Telcotrade OÜ and the purchaser(s) in all the matters resulting from the sale of goods through telcotrade.eu online catalogue.
9. Changes to the Terms
9.1. These terms were last changed on 15.05.2008.
9.2. Telcotrade OÜ retains the right, at its discretion, to change any of these terms in the future.
